Please read these Terms of Service carefully before using the Zafi DigiExpert website or any of our services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the services of Zafi DigiExpert, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. The materials contained on this website are protected by applicable copyright and trademark law.

2. Services

Zafi DigiExpert provides software development, web development, digital marketing, and related IT services. We reserve the right to:

• Modify or discontinue any service (or any part thereof) with or without notice
• Refuse service to anyone for any reason at any time
• Charge fees for certain services, which we will disclose to you before you begin using those services

3. Project Agreements

All project engagements are governed by a separate project agreement or statement of work (SOW) signed by both parties. In case of conflict between these Terms and any signed project agreement, the project agreement shall prevail.

4. Intellectual Property

Unless otherwise specified in a project agreement:

• All custom work product created for a client becomes the property of that client upon full payment.
• Zafi DigiExpert retains the right to display any work in our portfolio unless the client explicitly requests otherwise in writing.
• Open-source components used in projects remain subject to their respective licenses.
• Zafi DigiExpert's own branding, logos, and proprietary tools remain our intellectual property at all times.

5. Payments & Refunds

Our payment terms are as follows:

• A deposit of 50% is required before any project begins unless otherwise agreed in writing.
• Final payment is due upon project completion before final delivery or deployment.
• Refunds are evaluated on a case-by-case basis and are not guaranteed once work has commenced.
• Overdue payments may incur a late fee of 2% per month on outstanding balances.

6. Client Responsibilities

The client agrees to:

• Provide timely feedback, content, and required approvals to avoid project delays.
• Ensure all provided content (text, images, logos) does not infringe on third-party copyrights.
• Maintain the confidentiality of any login credentials provided by Zafi DigiExpert.

7. Limitation of Liability

In no event shall Zafi DigiExpert, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) our services
• Any conduct or content of any third party on our services
• Unauthorized access, use or alteration of your transmissions or content

Our maximum liability to you in any circumstance shall not exceed the total amount paid by you to Zafi DigiExpert in the six (6) months prior to the event giving rise to the claim.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project and not to disclose such information to third parties without prior written consent, unless required by law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts located in Lahore, Pakistan.

10. Changes to Terms

Zafi DigiExpert reserves the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the date at the top of this page. Your continued use of our services after any changes constitutes acceptance of the new Terms.
